Sperry Top-Sider® Sweepstakes - Official Rules

Eligibility: The Sperry Top-Sider Cabo Getaway Sweepstakes  (the “Sweepstakes”) is open only to legal residents of the fifty (50) United States (including D.C.) who are at least twenty-one (21) years of age at the time of entry. Void in Guam, Puerto Rico, U.S. Virgin Islands and other U.S. Territories, and where otherwise prohibited or restricted by law.  Employees, officers and representatives of Sponsor, as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee, officer, and representative are not eligible. Sweepstakes is subject to all applicable federal, state and local laws and regulations. Participation in the Sweepstakes constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to the Sweepstakes. Winning a prize is contingent upon fulfilling all requirements set forth herein.

Timing: The Sweepstakes begins on May 5, 2008 at 12:00 a.m. Eastern Time ("ET") and ends on July 7, 2008 at 11:59 p.m. ET. Sponsor’s computer is the official time-keeping device for the Sweepstakes.

How to Enter: YOU MAY ONLY ENTER THIS SWEEPSTAKES ONLINE.  NO OTHER METHOD OF ENTRY WILL BE ACCEPTEDTo enter, visit www.sperrytopsider.com/freetrip and complete and submit the online entry form by following all online entry instructions. ENTRIES MUST BE RECEIVED BY 11:59:PM EST ON July 7, 2008. Limit one online entry per person. If more than one entry is received per person, only the first such entry received will be eligible. In the event of a dispute regarding an entry, entries will be deemed to have been submitted by the authorized account holder of the email address submitted at the time of entry.  “Authorized Account Holder” means the natural person who is assigned to an email address by an Internet access provider, online service provider, or wireless service provider or any other organization that is responsible for assigning email addresses for the domain associated with the submitted email address. By entering the Sweepstakes, you are agreeing to receive future marketing e-mails from Sponsors.  If you do not want your email address used for future marketing purposes, please make sure the appropriate box on the entry form is unchecked.

Sweepstakes Prize Selection and Verification of Potential Winners: Winner will be selected in a random drawing from all eligible entries received. Random drawing will be conducted on or about July 21, 2008 by Sponsor, whose decisions are final. Winner will be notified by either email, mail or phone, at Sponsor’s descretion, and will be required to complete and return an Affidavit of Eligibility and Liability and a Publicity Release ("Affidavit") within 7 days of date specified on notification, or an alternate winner will be selected. If Affidavit is returned as undeliverable, it will result in disqualification, and the prize will be awarded to an alternate winner in a separate random drawing. If winner is otherwise eligible under these Official Rules, but is nevertheless deemed a minor in his or her state of primary residence, the prize will be awarded in the name of winner's parent or legal guardian who must execute and sign Affidavit on winner's behalf.  Odds of winning depend on number of eligible entries received.

Prize/Approximate Retail Value ("ARV"): One (1) Grand Prize: Grand Prize is a six (6) day/ five (5) night trip to Cabo Villas Beach Resort in Cabo San Lucas (the “Resort”) between October 19 – 24, 2008 for winner and one (1) guest. (ARV: $5,400.00). Actual value of prize depends on the city of departure, time of travel, any airfare fluctuations and on current market conditions at the time of prize fulfillment, and any difference between the stated ARV and the actual value, if any, will not be awarded.
Grand Prize includes roundtrip coach air transportation for two (2) from a major US  airport nearest winner’s residence to Cabo San Lucas, airport transfers to and from the Resort, five (5) nights accomodations (one standard bedroom) at the Cabo Villa Beach Resort Timeshare for two (2), a meal and activity credit of $1,5000 and four (4) pairs of Sperry Top-Sider footwear (Gold Cup and Croc series excluded). Dates of trip, location, travel arrangements and accommodations are at Sponsor's sole discretion. If winner cannot travel on Sponsor designated dates in October 2008, prize will be forfeited in its entirety and an alternate winner may be selected. No alternate prizes will be awarded.
Five (5) First Prizes: Each First Prize is one Sperry Top-Sider branded Emotion Kayak, touring paddle and a gift certificate for one (1) pair of Sperry Top-Sider footwear (Gold Cup and Croc Series excluded).  Winners of First Prizes must meet special shipping requirements for the delivery of the kayak.. (ARV of each First Prize: $529). 
Ten (10) Second Prizes: Each Second Prize is a gift certificate for one (1) pair of Costa Del Mar sunglasses and a gift certificate for one (1) pair of Sperry Top-Sider footwear (Gold Cup and Croc series excluded) (ARV of each Second Prize: $500).
Twenty-Five (25) Third Prizes Each Third Prize is a gift certificate for a pair of  Sperry Top-Sider footwear (Gold Cup and Croc series excluded) (ARV of each Third Prize: $100). Total ARV of all Prizes is approximately $15,545.

All expenses not specified in these Official Rules are the winner’s sole responsibility. Winners of gift certificates must comply with all of the terms and conditions of the gift certificate to receive prize. Grand Prize winner and guest must travel at the same time and on the same itinerary and share a standard hotel room. Guest of Grand Prize winner (if minor in jurisdiction of residence, his/her parent or legal guardian) must sign and return a liability release and, where legal, publicity release, prior to booking. All travelers must possess required travel documents (e.g. Passport, valid photo I.D.) prior to departure. Travel arrangements will be made by Sponsor. If Grand Prize winner is not accompanied on trip with a guest, winner will not receive any compensation in conjunction therewith.  Sponsors will not replace any lost or stolen tickets, travel vouchers, passes, certificates or similar items once they are in the winner’s possession or in the possession of winner’s guest. The prize restrictions/conditions stated herein are not all-inclusive and the prize may be subject to additional restrictions/conditions as set forth in the affidavit/release and/or prize travel documents; such additional restrictions/conditions are incorporated by reference herein. No cash equivalent. All prizes are non-transferable and no substitution will be made except as provided herein at the Sponsors’ sole discretion. Sponsor reserves the right to substitute any listed prize for one of equal or greater value if the designated prize is not available for any reason. Winner is solely responsible for all federal, state and local income taxes and fees associated with prize receipt and/or use. All expenses not specified in these Official Rules are the winner’s sole responsibility. Grand Prize winner will receive IRS form 1099 in connection with accepting Grand Prize.

Publicity: Except where prohibited, participation in the Sweepstakes constitutes winner's consent to Sponsor's use of winner's name, likeness, photograph, voice, opinions, biographical information, hometown and state for promotional purposes in any media without further payment or consideration.

General Conditions: Sponsor reserves the right to cancel or modify the Sweepstakes if fraud, technical failures or any other factor beyond Sponsor's reasonable control impairs the integrity of the Sweepstakes, as determined by Sponsor in its sole discretion. In such event, Sponsor reserves the right to award the prizes at random from among the eligible entries received up to the time of the impairment. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or any other Promotion, or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately damage any web site or undermine the legitimate operation of the Sweepstakes is a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

Release: By receipt of any prize, winner agrees to release and hold harmless Sponsor and any promotional partners, each of their parent, subsidiary, affiliate and related companies, and each of its and their respective officers, directors, employees, and agents (collectively the “Released Parties”) from and against any losses, damages, rights, claim or cause of action of any kind arising, in whole or in part, directly or indirectly, out of participation in the Sweepstakes or resulting directly or indirectly, from acceptance, possession, use, or misuse of any prize awarded in connection with the Sweepstakes, including, without limitation, personal injury, death, and/or property damage, as well as claims based on publicity rights, defamation, and/or invasion of privacy.

Limitations of Liability: The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Sweepstakes; (4) technical or human error which may occur in the administration of the Sweepstakes or the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or receipt or use of any prize or while traveling to or from any prize-related activity. If for any reason an entrant’s entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Sweepstakes, provided that, if it is not possible to award another entry due to discontinuance of the Sweepstakes for any reason, Sponsor, in its sole discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than the stated number of prizes as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, un-awarded, eligible prize claims.
